Terms of sale - consumer customers

1 General terms and conditions

These terms of sale apply to the sale of goods and services to consumers from RoMobil AS.

These terms of sale, together with your order and order confirmation, will constitute the overall contractual basis for the purchase.

If you are under the age of 18, you can only shop if you have your own bank card (debit card) that can be used for this. You may not use the other payment methods that apply (see, for example, section 4). You can also have a guardian make the purchase for you.

We only deliver to mainland Norway and Svalbard. All goods delivered by RoMobil can be used in Norway.

All prices are stated including value added tax (VAT).

Consumer purchases are regulated by, among other things, the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, the Personal Data Act, the E-Commerce Act and the Credit Purchase Act.

2 Order and agreement process

Your order is binding when the order is registered with us. At the same time, we are bound by your order if it does not deviate from what is offered by us in our online store,
our marketing or in any other way.
We reserve the right to cancel an order or part of it if it deviates from what we have offered in our online store, our marketing or otherwise does not correspond to offers made by us, e.g. in the event of quantity limitations, suspicion of purchases as part of commercial activities, etc.

Consumers have the right to withdraw from the purchase in accordance with the Act on the Right of Withdrawal, see section 6 of the agreement. 6.

RoMobil is bound by the price stated to you at checkout, see also section 3 below.
In the event of discrepancies in our stock or if an item is out of stock, your order, or parts of it, may be canceled. In such a situation, you will be notified of this, possibly together with information about what we can offer instead.

RoMobil will send an order confirmation when the order is placed. The Seller must then notify you if something is out of stock. Your receipts from the Seller will be delivered to you by being uploaded to "My Page/Order Overview", on the estimated delivery date, regardless of the payment method chosen.

3 Prices

All prices are inclusive of VAT. The total cost of the purchase will appear before completion of an order and include all expenses associated with the purchase such as expenses for postage, shipping, packaging, etc.

When purchasing goods from RoMobil for deliveries to places where no VAT is payable, the prices will nevertheless be inclusive of VAT, which may have to be refunded afterwards.

Prices are constantly changing and we reserve the right to make price changes until the completion of each purchase, as a result of changed prices from our suppliers or currency changes.

We also reserve the right that typographical or printing errors of significant size in the online store, marketing or the like may cause RoMobil to unilaterally delete, reject or recall orders. However, such errors must be corrected within a reasonable time after the error is discovered.

4 Payment

The purchase price can, at your own choice at checkout, be paid by bank or credit card, Vipps or Klarna.

If you choose purchase financing as a payment method, separate agreements will be entered into for the financing, and you will receive information and agreement documents from the relevant financing provider at checkout. A credit check will also be carried out and a counterpart letter will be sent after such an application for credit.

If you choose invoice or purchase financing from Klarna and this is granted, Klarna will in such cases settle the purchase price with RoMobil on your behalf, and you must settle with Klarna in accordance with the terms of the chosen financing solution.

When using a card or Vipps, the purchase price will be reserved on the card when ordering. That is, upon completion of the shopping cart. The card will be charged on the same day as the shipment is made.[FE3] [TD4] 

Uncollected and unpaid parcels will be charged a fee of NOK 250 + return shipping of the applicable order, to cover our expenses.
In the event of non-payment, the claim will, after prior notice, be sent to debt collection.

5 Delivery

All general delivery times stated on RoMobil must be regarded as indicative. When delivery time is stated in number of days, weekdays are meant, and the charterer's time is always added. The Seller reserves the right to change the stated general delivery time without further notice.

If the delivery of the products is delayed, RoMobil will inform you as soon as we have knowledge of it, together with information about whether and when delivery can take place, or whether the product(s) are out of stock.

If the delivery is delayed, you will be able to cancel the purchase, see section 7 of these terms and conditions. If you cancel your purchase due to delayed delivery, we will refund the purchase price within 14 days. The refund of the purchase price will be made using the same means of payment that you used when ordering.

Delivery of the products will take place in the manner, at the place and at or by the time agreed (see points 1 and 2 above). RoMobil is responsible for the products until they are taken over by you, i.e. when you have taken possession of the products.

For home delivery, you must be at home to sign for delivery.

After you have received the products, you should, as soon as possible, check that the delivery is in accordance with the shipment confirmation. Check whether the products have been damaged during transportation or whether the products are otherwise faulty or defective. If the shipment has been damaged during transportation, or if what you have received does not match what you have ordered, please contact us as soon as possible. Take care of the packaging and product until the case has been processed and you have received feedback from us.

Any price changes that occur after the time of ordering will not have retroactive effect.

Instructions for use in Norwegian or English will be included or available on the manufacturer's website.

6 Right of withdrawal

The Right of Withdrawal Act gives you the right to cancel your purchase. The right of withdrawal applies to goods and certain services (see exceptions in the last paragraph). The right of withdrawal requires that you notify the Seller of the delivery no later than 14 days after you receive the delivery (withdrawal period). The goods must be sent to us no later than 14 days from the date on which notification of use of the right of withdrawal was given.

If you have not received a right of withdrawal form either in the shipment confirmation or upon delivery of the products, the withdrawal period expires 12 months after the expiry of the original withdrawal period. If you receive the withdrawal form within these 12 months, the withdrawal period expires 14 days after the day you received the withdrawal form.

For the right of withdrawal to be applicable, the product must be returned to the Seller of the product in approximately the same quantity and condition as you received it. If you use or examine the product(s) in a way that goes beyond what is necessary to determine the nature, characteristics and function of the product and this results in the product being reduced in value, the Seller may deduct an amount corresponding to the reduction in value from the purchase price to be repaid.

All products must be returned to the Seller within a reasonable time when using the right of withdrawal.
The Buyer bears the risk of transporting the goods back to the Seller.

The Seller is obliged to reimburse you for what you have paid, including postage for the shipment, handling fees, customs fees, collection fees, etc. This only applies when the entire purchase is returned. If you have expressly opted for special shipping beyond what is necessary to ship the item, this shall be paid by you.

Refunds shall be made within 14 days after the Seller has received the notification of regret, but not before 2 days after the Seller has received the return from you, or documentation from you that you have sent the return back to the Seller.
The product must be returned to the Seller in its original packaging, together with a completed withdrawal form. The return shall be made to the Seller in accordance with the applicable terms and conditions.

The refund of the purchase price will be made using the same means of payment that you used when ordering, unless otherwise agreed or there is an obstacle to repayment by the payment method used.

The right of withdrawal does not apply when it follows from the law that the customer has no right of withdrawal.

7 Delay in delivery

If the Seller fails to deliver the goods, or delivers them too late in accordance with the agreement, and this is not due to you or circumstances on your part, you may, in accordance with the rules in Chapter 5 of the Consumer Purchases Act, under the circumstances withhold the purchase price, demand performance, terminate the agreement or claim compensation from the Seller.

In the event of delay, claims must be made to the Seller within a reasonable time.

8 Complaints and warranty

If a defect or deficiency is discovered, you must notify the Seller within a reasonable period of time after you discovered, or should have discovered, the defect (complaint). However, the deadline for making a complaint is not shorter than two months from the time when you discovered the defect. Complaints must be made no later than two years after you took possession of the goods. If the product or parts of it are intended to last significantly longer under normal use, the latest deadline for making a complaint is five years. If you do not make a complaint in time, you lose the right to claim the defect.

Notification of defects and deficiencies in the products can be given to the Seller verbally or in writing. For the sake of evidence, we recommend that the complaint is sent in writing by e-mail to retur@romobil.no.

You will receive a confirmation of receipt of the complaint with a return number, which will be sent by e-mail to the e-mail address from which you sent the complaint. The confirmation will also state whether special conditions/handling are required from the buyer in connection with the return of the goods (e.g. antistatic protection or return directly to the manufacturer).[FE5] [TD6] 

If there is a defect in the item and this is not due to you or circumstances on your part, and you have complained within the aforementioned deadlines, you may, in accordance with the rules in Chapter 6 of the Consumer Purchase Act:

  1. withhold all or part of the purchase price (if it has not already been paid)
  2. under certain conditions, choose between rectification or replacement
  3. under certain conditions, demand a price reduction
  4. under certain conditions, claim compensation
  5. demand rescission, if the defect is not insignificant (it is normally a prerequisite for rescission that the goods are returned in the same condition and quantity, cf. the Consumer Purchase Act § 51).

If there is no defect, the Seller may only demand payment for investigations that have been necessary to determine whether there is a defect, and payment for the repair of the goods, if we have expressly made you aware that you must cover such costs yourself, the Consumer Purchase Act § 30.

If you, on your own initiative, take measures to rectify the defect beyond what may have been agreed with the Seller, the Seller will not pay these expenses.

The Seller reserves the right to reject a complaint if it turns out that the item has no defect under applicable consumer legislation.

The Seller is responsible for return shipping for approved complaints.

When sending goods purchased from RoMobil to a service partner, you must contact the service partner yourself to arrange the return. See under Service routines, on "Complaints and warranty" on our customer service pages.

If the Seller's rectification or redelivery will result in you being prevented from using the item for more than ten days, under certain conditions, you are entitled to demand that a replacement item be made available at the Seller's expense.

If you send your product to one of RoMobil's service partners, or RoMobil sends your product to a service partner, the service partner may contact you as a customer directly.

If you ask us to delete your customer account, all purchase history will also be deleted. It is important that you keep receipts for your purchases in connection with any future complaints. Without a receipt, no warranty/complaint can be used. If, after deletion of your customer account, you need to return goods to us in connection with a complaint, a new customer account must be created in order for us to be able to handle the complaint.

9 Payment by card

As a general rule, we do not undertake to store card numbers beyond what is necessary to ensure effective handling of any problems with debiting, canceling reservations and crediting.

10 Personal data

When you shop at RoMobil, RoMobil has the right to process your personal data to the extent necessary to fulfill the sales agreement. This includes information such as your name, email address, telephone number, payment information, postal address and any other delivery address, as well as any other relevant information you provide to us.

11 The customer's obligations

Anyone registered as a customer with RoMobil is responsible for payment of the services provided by RoMobil in accordance with these terms and conditions. This responsibility also includes the use of the customer's access by others, including use by unauthorized persons, unless it can be shown that the unauthorized person's use is made possible through negligence on the part of RoMobil. As a customer, you are also responsible for ensuring that the information provided in your account is correct. This information can be managed in the online store by logging into your account. Name changes must be made by contacting our customer center.

12 Extraordinary circumstances

The seller is only liable for loss of value for the item if defects or deficiencies are proven. However, this does not apply if we prove that the defect is due to circumstances beyond our control and which we could not reasonably be expected to avoid or overcome the consequences of.

The Seller is not liable for indirect losses as a result of defects unless the loss is caused by gross negligence or intent on the part of the Seller.

13 Changes to the terms and conditions

We reserve the right to amend these terms and conditions, including as a result of changes in legislation.

14 Force majeure

If we are prevented from delivering or making a mandatory redelivery, or if such a delivery obligation becomes unreasonably onerous as a result of a labour dispute or any other circumstance beyond the control of the parties, such as fire, war, mobilization or unforeseen military call-ups of similar scope, requisition, seizure, currency restrictions, riots and civil commotion, shortage of means of transportation, general shortage of goods, restriction in the supply of fuel, as well as defects or delays in deliveries from subcontractors or manufacturers as a result of such circumstances as referred to in this section, the Sellers are exempt from all liability other than in cases of complaints and credit it to the defective goods' associated purchase price.

15 Disputes and choice of law

Disputes relating to the terms and conditions and associated provisions, as well as disputes that otherwise relate to trade on RoMobil follow Norwegian law and are subject to the ordinary dispute resolution bodies and courts.

If you wish to complain about a product or service purchased from us, you can file a complaint with the Norwegian Consumer Authority. The Norwegian Consumer Authority oversees consumer protection rules, enforces consumer legislation and works to safeguard consumers' rights and interests.
